Agreement between User & Fuel My Ride (FMR)
Welcome to Fuel My Ride (Also referred to as FMR in contract) FMR is offered to you conditioned on your acceptance without modification of the terms, conditions, & notices contained herein. Your use of FMR constitutes your agreement to all such terms. Please read these terms carefully, and keep a copy of them for your reference.
Electronic Communications
Visiting FMR Facebook or sending emails to FMR constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications (text messages) that we provide to you electronically, via email, & on Facebook site, or text messages satisfy all legal requirements that such communications be in writing.
Children Under Thirteen
FMR does not knowingly collect, either online or offline personal information from persons under the age of thirteen. If you are under 18, you may use FMR only with permission of a parent or guardian.
Indemnification
You agree to indemnify, defend, and hold harmless FMR and its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorneys fees) relating to or arising out of your use of or inability to use the site or services, any user postings made by you, your violation of any terms of this agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. FMR reserves the right at its own cost to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with FMR in asserting any available defenses.
Arbitration
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms & Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions.
Termination
FMR reserves the right, in its sole discretion, to terminate your access to its services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by laws of the State of Wisconsin and you hereby consent to the exclusive jurisdiction and venue of courts in Wisconsin in all disputes arising out of or relating to use of our services.
You agree that no joint venture, or partnership exists between you and FMR as a result of this agreement or use of this service. FMR’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of FMR’s right to comply with governmental, court, and law enforcement requests or requirements relating to your use of FMR’s services.
Changes to Terms
FMR reserves the right, in its sole discretion, to change the terms under which FMR is offered. The most current version of the terms will supersede all previous versions. FMR encourages you to periodically review the Terms to stay informed of our updates.
APPLICABILITY & ACCEPTANCE OF THESE TERMS OF USE. Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a legally binding agreement between you and FMR. If you do not agree to these Terms, you may not access or use the Services. FMR reserves the right, in our sole and absolute discretion, at any time, for any reason whatsoever, with or without notice, to terminate, suspend, amend, or modify the Services and/or the Terms related to the Services, which will be effective upon the posting of such updated Terms by FMR. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended. FMR may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.
Payment for Services
You understand, acknowledge, and agree that use of the Services will result in charges to you immediately after delivery. Charges paid by you are final and non-refundable, unless otherwise determined by FMR. All Charges are due immediately and payment will be facilitated by FRM using the payment method designated in your Account. If your payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that FRM may use a secondary payment method in your Account, if available or contact me immediately to update payment method and clear up any balance owed. FMR reserves the right to charge a late payment fee of $40.00 if you fail to pay the balance past the payment deadline within 24 hours or for an ACH transaction return. Should your account become delinquent, we reserve the right to initiate collection to collect the debt. In addition to the amount due, the customer agrees to pay all costs of collection, court cost, including attorneys’ fees if necessary.
FMR, in our sole and absolute discretion, at any time, for any reason whatsoever, with or without notice, reserves the right to establish, modify, amend, change, remove and/or revise Charges for any or all Services. FRM will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof. FMR may from time to time provide certain users with promotional offers and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the Services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you.
You may elect to cancel your request for Services at any time prior to the dispatch of a delivery vehicle, in which case you will NOT incur Charges.
In the event that a delivery vehicle is unable to fill your vehicle with fuel for any reason outside of FRM’s control, including but not limited to, your vehicle not being in the location designated, your vehicle’s gas tank door being locked, and/or inaccessible for any reason, FMR will attempt to contact you; should the delivery vehicle remain unable to fill your vehicle with fuel within five (5) minutes of the delivery vehicle’s arrival at the location designated, you will incur a delivery fee of $20, regardless of any promotional offers and/or discounts to which you may have previously been eligible.
Payment for Services cont.
FMR’s users understand and acknowledge that gas prices fluctuate and change hourly, therefore, determination of all matters regarding pricing and the amounts to bill customer may be changed by FMR at any time in FMR’s sole discretion.
For all gas deliveries FMR will charge for a minimum of 7 gallons notwithstanding the user vehicle only needing less than 7 gallons. There will be no exceptions to the minimum fuel charge.
By using our services, you agree to accept the full responsibility for any damages that may occur. FMR will use local gas stations to supply your fuel. So you do not hold FMR responsible for any fuel related mechanical failure that may occur.
Our users grant FMR permission to fuel their cars and they agree to grant us all access necessary to complete the FMR service.
